Hospital acquisitions of physician practices have become a significant trend in U.S. healthcare, and two pending cases – one in the Eighth Circuit Court of Appeals and one in Washington state court – are proof that antitrust enforcers won’t take a pass at challenging physician transactions that enforcers believe will substantially lessen competition. This luncheon will explore recent cases, provide insight on when physician transactions are most likely to draw antitrust scrutiny, and explore what hospitals and physician groups can do to anticipate and respond to antitrust concerns.
