Fifteen Years of Olmstead: Evolution of the ADA Integration Mandate

In connection with the 15th anniversary of the U.S. Supreme Court’s decision in Olmstead v. L.C., 527 U.S. 581 (1999), the Behavioral Health Task Force is pleased to present this roundtable discussion that brings together Steven Caley, an attorney who represented the plaintiffs, Lois Curtis and Elaine Wilson, in the original litigation, and Anne Raish, a U.S. Department of Justice (DOJ) Deputy Chief and trial attorney involved in recent Olmstead enforcement actions, to examine the U.S. Supreme Court’s Olmstead holding and subsequent DOJ enforcement efforts.

In Olmstead, the Court held that the institutionalization of Curtis and Wilson in a state psychiatric hospital violated the Americans with Disabilities Act’s integration mandate requiring persons with disabilities to receive services in the most integrated setting appropriate to their needs. Since the Olmstead decision, the DOJ has enforced the mandate and applies it to public entities that: (1) directly or indirectly operate facilities and or/programs that segregate individuals with disabilities; (2) finance the segregation of individuals with disabilities in private facilities; and/or (3) through planning, service system design, funding choices, or service implementation practices, promote or rely upon the segregation of individuals with disabilities in private facilities or programs. The roundtable discussion will be moderated by Matthew Caspari, general counsel with the DC Department of Behavioral Health, who will address Olmstead challenges and opportunities encountered by public and private entities.
