Date: Tuesday, March 31, 2009 Time: 1-2:30 pm Eastern Description: This teleconference will explore the interplay between the HIPAA Privacy Rule and the Common Rule to explore whether this widely held view is based upon perception or fact. The teleconference will begin with a description of commonplace questions that confront Institutional Review Boards and areas of confusion that often arise. There is a widely held view in the research community that the HIPAA Privacy Rule is a net negative influence on the conduct of clinical research. Most researchers believe that the Common Rule, the long standing set of standards for the conduct of research, provided adequate protection of privacy interests without unduly restricting researchers. Our expert faculty will offer an objective assessment of where HIPAA and the Common Rule are in conflict, and where they can be harmonized. Finally, we will look at the effect of HIPAA on evolving areas of research where databases and other newer technologies seem to have outgrown the boundaries of the Privacy rule. The teleconference will be an intermediate level program and will presume some prior knowledge of HIPAA rules on research and authorizations. The target audience for this teleconference is lawyers who practice in the fields of research, technology, privacy and security. hat often arise.

Program Description

After a series of cases chipping away at the healthcare industry, the Office of Federal Contract Compliance Programs (OFCCP) is claiming victory after the ALJ’s decision in OFCCP v. Florida Hospital holding that the hospital, a TRICARE provider, was a government contractor and subject to Executive Order 11246, Section 503 of the Rehabilitation Act of 1973 and the Vietnam Era Veterans' Readjustment Assistance Act of 1974. The OFCCP expects TRICARE providers to be in compliance with the federal contractor regulations even though Florida Hospital is still on appeal. What can you do to prepare for an OFCCP compliance review notice? At this webinar, you will learn the first steps in establishing an affirmative action plan, including practical advice that will help you assess your current systems and infrastructure in order to gather the information you will need in place to satisfy the legal requirements of the federal contractor regulations. In addition, you will hear about the OFCCP's evolving audit and compliance review procedures as they relate to healthcare providers and what to do (and not to do) when the OFCCP comes knocking on your door.
