HLD, v. 32, n. 5 (May 2004)

U.S. Supreme Court Denies Review Of Federal Circuit's Ruling Upholding 30-Day Suspension Of Nurse

The U.S. Supreme Court denied review of the Federal Circuit's ruling upholding the Merit Systems Protection Board's decision affirming the Indian Health Service's thirty-day suspension of a nurse for rude behavior to co-workers, and did not err in considering hearsay statement of co-worker and nurse's previous work history of inappropriate behavior in calculating penalty. The Federal Circuit's decision is published at 73 Fed. Appx. 445.
