Proposed Attorney-Client Privilege Legislation

Email Alert

August 13, 2007

The Corporate Governance Task Force has learned that the House of Representatives will soon consider legislation to restrict the Justice Department's ability to pressure corporations to waive the attorney-client privilege in exchange for leniency in charging decisions in criminal cases. The House bill is sponsored by Rep. Bobby Scott (D–Va.). That bill is identical to a separate Senate measure, S. 186, pending in the Senate. Access the Senate bill.

AHLA wishes to thank Stuart Silverman, Chair of the Corporate Governance Task Force, for providing this update.
