Hospital and Health System counsel often face many technical and operational issues with Health Insurance Portability and Accountability Act (HIPAA) Security rule compliance, including meeting the risk assessment and compliance documentation standards under the rule. Establishing and documenting a risk assessment and correcting any deficiencies is now required as a core objective under the Medicare and Medicaid Electronic Health Records Incentive Program, and hospitals and eligible professionals must attest to this objective.
