Executive Summary - December 2016

Health Care Organizations as Data Owners and the Intellectual Property Associated with Health Care IT Contracts
Amy Jo Davis (Lumeris/Essence Healthcare, Maryland Heights, MO)
Seth M. Wolf (University Hospitals Health System Inc., Beachwood, OH)

This Executive Summary addresses issues arising from the economic and competitive significance of data generated by health care providers and health care information technology vendors. It suggests that data itself is an asset, and describes protections that creators or owners of this asset may seek to implement. The Executive Summary also describes operational issues arising from the provision of data, and how these issues might be addressed in an agreement.
