The Heartland Specialty Hospital Case

Member Briefing - November 2008

The Heartland Specialty Hospital Case
David A. Ettinger, Esquire

Honigman Miller Schwartz and Cohn LLP, Detroit, MI
A district court in Kansas denied summary judgment to defendant hospitals and health plans in an antitrust challenge by a physician-owned specialty hospital to an alleged conspiracy to boycott the hospital to keep it from obtaining managed care contracts. Attached is a Member Briefing that analyzes the summary judgment decision and certain Daubert rulings on plaintiffs' expert's damages assessment.
