The panel will explore the much-anticipated proposed rule implementing the “sunshine” provisions of the Affordable Care Act (ACA). The proposed rule requires certain manufactures of drugs, devices, and biologics to report to the Centers for Medicare & Medicaid Services (CMS) information regarding payments and other transfers of value to covered physicians and teaching hospitals. Additionally, the proposed rule would require certain manufactures and group purchasing organizations (GPOs) to report physician ownership interests in such organizations. The panel will discuss the various aspects of the proposed rule and offer insight into the challenges that will be created by the proposed rule in its current format.
