Description

This presentation will address the following topics:

  • Overview of law and key issues and cases
    • What is the federal Anti-Kickback Statute (AKS)?
    • Who does it apply to and how is it different than the federal Stark Law?
    • What is a "remuneration" for purposes of the AKS and how might that be changing/expanding (e.g., Fry/Christ Hospital)?
    • Are there any safe harbors to the AKS?
    • How has the government enforced the AKS?
    • Recent cases/settlements (where is the U.S. Department of Justice going with AKS enforcement?), Office of Inspector General (OIG) Advisory Opinions (focus on unfavorable opinions, problem arrangements), and other guidance, connection to Stark claims.
    • What is the OIG Self-Disclosure Protocol, and how does it impact counseling clients on potential violations?
    • How has healthcare reform changed the AKS and the government’s enforcement posture? (Sixty-day overpayment rule, Anti-Kickback violation now clearly can be the basis of False Claims Act case.)
