After a series of cases chipping away at the healthcare industry, the Office of Federal Contract Compliance Programs (OFCCP) is claiming victory after the administrative law judge's decision in OFCCP v. Florida Hospital holding that the hospital, a TRICARE provider, was a government contractor and subject to Executive Order 11246, Section 503 of the Rehabilitation Act of 1973, and the Vietnam Era Veterans' Readjustment Assistance Act of 1974. OFCCP expects TRICARE providers to be in compliance with the federal contractor regulations even though Florida Hospital is still on appeal. What can you do to prepare for an OFCCP compliance review notice?
