The Health Information Technology for Economic and Clinical Health (HITECH) Act has intensified the race to create, adopt, and implement comprehensive electronic health record (EHR) systems. HITECH places deadlines on the creation of standards regarding interoperability and meaningful use of EHRs. This webinar will examine the tensions between the rush to create such standards and the potential antitrust issue that may arise in the standard-setting process.
In this interdisciplinary session, we will explore:
- The requirements under HITECH to create standards for interoperability;
- Antitrust issues that arise in the standard-setting process, such as conflicts of interest, failure to follow an appropriate process, and technology hold-ups;
- Potential defenses and immunities under the antitrust laws applicable to the standard-setting process;
- How the antitrust laws and HITECH interact; and
- Practical issues regarding implementation of HITECH and tensions between HITECH and the antitrust laws.
