Description
State Attorneys General offices have been increasingly active in investigations, litigation, and prosecution against healthcare providers, pharmaceutical companies, and payors. State AGs have recovered hundreds of millions of dollars from pharma manufacturers for alleged Average Wholesale Price manipulation; entered into settlements dramatically reshaping Usual, Customary, and Reasonable calculations; examined physician ranking and P4P Programs; and, through the proliferation of state False Claims Acts, substantially escalated their fraud enforcement.
On this panel, we will hear from state AG officials regarding their healthcare industry litigation priorities, learn how they evaluate cases to bring on behalf of their offices, explore what influences their decision to settle versus litigate cases, and hear what they have seen work and not work from attorneys representing clients in these matters.
On the defense side, the panel will explore special considerations involved in state AG reviews, from a "when to" and "whether to" approach the AG himself or herself, to dealing with multi-jurisdictional investigations involving federal and state players.
