Liability and Governance Issues Arising from Never Events and Other Unanticipated Outcomes 

Description:

This session will focus on never events, unusual occurrences, and state laws mandating apologies by medical professionals. Specific attention will be given to avoiding the risks, the reimbursement ramifications to a hospital system when these events occur, as well as the fiduciary duties of boards of directors to ensure proper risk assessments, monitoring/reporting, and options for adequate insurance coverage. Additionally, the speaker will discuss exposure to malpractice actions from reporting obligations, and state laws allowing for exclusion of evidence arising from reporting duties imposed on providers.
