Professional Profile:
Mr. Shay is a partner in the Health Care Practice Group in the firm's Washington, D.C. office. His practice includes the representation of hospitals, single and multi-specialty physician group practices, nursing homes, ambulatory surgery centers, community health centers and other health care providers on a wide range of regulatory and transactional matters. He currently represents numerous providers before administrative agencies and federal courts on Medicare reimbursement matters. Mr. Shay also represents hospitals, physician groups and other health care providers in complex overpayment recoupment efforts, fraud and abuse investigations, and various compliance audits. In these representations, Mr. Shay often negotiates resolutions with representatives of the Centers for Medicare & Medicaid Services and/or the Department of Health & Human Services' Office of Inspector General. Other examples of Mr. Shay's health care experience include representing hospitals and physicians in the purchase and sale of physician practices and the formation of ancillary care providers, such as ambulatory surgery centers and imaging centers. As part of these engagements, he counsels hospitals and physicians on federal and state self-referral restrictions and anti-kickback laws.
Mr. Shay has lectured and written on many occasions on fraud and abuse matters, physician self-referral restrictions, and the development of corporate compliance programs.
Mr. Shay currently serves as the American Health Lawyers Association's Vice Chair of the Fraud and Abuse, Self-Referrals, and False Claims Substantive Law Committee. Mr. Shay served on the Editorial Board of St. Anthony Publishing and was a member of the U.S. Chamber of Commerce's subcommittee on health care.
