Kim Harvey Looney is a partner at Waller Lansden. Ms. Looney is recognized in The Best Lawyers in America (Woodward White, Inc.) for her extensive experience in healthcare law and she has been honored in the Nashville Business Journal's Best of the Bar Listing since 2005. Ms. Looney provides counsel to hospitals, physician groups, and outpatient services providers on day-to-day operational issues related to recruitment and employment and maintaining ongoing compliance with Stark and anti-kickback regulations. She also assists hospitals and physicians with medical staff issues. Ms. Looney works with healthcare providers on Medicare and Medicaid (TennCare) enrollment and reimbursement issues, and she provides counsel on fraud and abuse regulations. Her experience with healthcare regulatory matters also includes EMTALA.
In addition, Ms. Looney advises clients on healthcare regulatory issues pertaining to mergers, acquisitions, and joint ventures. She recently provided counsel on the regulatory aspects of the acquisition of a large institutional pharmacy by a leading private equity firm. Her transactional experience also includes the representation of a physician group in a joint venture with a not-for-profit hospital and the merger of three radiology groups.
Ms. Looney assists physician groups, hospitals, ambulatory surgery centers, imaging centers, nursing homes and assisted living facilities, continuing care retirement communities, home health agencies, and other provider facilities in operational, licensing, and regulatory issues. She has extensive experience preparing certificate of need (CON) applications and representing clients in CON administrative hearings. She successfully represented clients in CON proceedings which resulted in the approval of the first 3-Tesla MRI Scanner and the first Stand-Up MRI Scanner in Middle Tennessee.
Prior to law school, Ms. Looney worked as a healthcare consultant for Research and Planning Consultants in Austin, Texas, where she conducted feasibility studies and long-range plans for a variety of healthcare providers. Previously, she worked for Electronic Data Systems in Dallas, Texas, as a professional relations representative, responsible for education and assistance in claims processing to healthcare providers who participated in the Medicaid program.
Prior to joining Waller Lansden, she served as the co-chair of the healthcare practice group at Adams & Reese/Stokes Bartholomew located in Nashville, Tennessee.
