Barry D. Alexander is a partner of Nelson Mullins Riley & Scarborough LLP in the Firm's Raleigh office practicing in healthcare law, Medicare and Medicaid reimbursement, and healthcare fraud. Additionally, Mr. Alexander provides legal and regulatory counseling on federal and state fraud issues, including corporate compliance, anti-kickback, self-referral, false claims and health information privacy matters, including issues involving the Health Insurance Portability and Accountability Act. Mr. Alexander is also Chair of the Firm's National Healthcare Practice Group.

Mr. Alexander's experience includes:

  • Representation of regional and national providers in matters related to Medicare reimbursement disputes before various Medicare contractors, state Medicaid agencies and the Centers for Medicare and Medicaid Services (CMS).
  • Representation of hospitals, healthcare systems and durable medical equipment suppliers in Medicare billing and other regulatory disputes with the U.S. Department of Justice; resolving potential civil exclusionary actions, and negotiating and implementing corporate integrity agreements with the Department of Health and Human Services Office of the Inspector General (OIG).
  • Representation of a medical device manufacturer in settling multimillion dollar Medicare Secondary Payor liability and CMS, and the U.S. Department of Justice in connection with a product recall and the settling of private third-party payor subrogation claims.
  • Representation of practice management and third-party billing companies in reimbursement and policy matters before CMS and formally voluntary disclosure matters before the OIG.

Mr. Alexander is admitted to the bars of North Carolina and the District of Columbia. He is the author of Health Reform: "False Claims Enforcement Under a New Regime," Public Contracts Law Journal, Fall 1994; "CMS Issues Final (Final) Provider-Based Rules: And Why is This So Important Again?" and "Provider-Based Guidelines Partially Suspended by BIPA 2000 Enactment," Health Care Legal Alert, August 2002 and January 2001, respectively. Mr. Alexander frequently speaks on healthcare compliance topics including Medicare reimbursement, HIPAA compliance, and fraud and abuse matters including defense of healthcare providers and suppliers faced with civil False Claims Act matters.

Mr. Alexander is a member of the American Bar Association (Health Law Section); the American Health Lawyers Association; and the N.C. State Bar (Health Law Section). Active in the community, Mr. Alexander currently serves as president of the Central Area Chapter of the American Lung Association of North Carolina.

In 1994, Mr. Alexander earned a Juris Doctor from the George Mason University School of Law. He earned a Bachelor of Arts in Philosophy from George Mason in 1989.
